1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site, create an account, or purchase services. By using the Site, you represent that you meet these requirements and that all registration information you provide is accurate and current.
2. User accounts
You may register for a free client account using supported sign-in providers (such as Google or Facebook) or other methods we offer. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, pose a security risk, or are used for prohibited purposes.
3. Services we offer
The Site provides:
- A free directory of arrest and inmate records compiled from public sources;
- Informational guides and facility content;
- Paid family services such as bail bond referrals, inmate mail, care packages, and discounted phone calls, fulfilled by third-party providers; and
- Links to paid public-records searches operated by TruthFinder, our affiliate partner.
Fees, delivery times, facility restrictions, and availability vary and are disclosed at checkout or on the relevant service page. We may modify or discontinue any feature with reasonable notice where practicable.
4. FCRA and permitted use
The Site is not a consumer reporting agency under the Fair Credit Reporting Act (FCRA). Directory information and links to TruthFinder are for personal, informational purposes only. You agree not to use the Site or any information obtained through it for any purpose governed by the FCRA, including employment screening, tenant screening, credit or insurance decisions, education or scholarship eligibility, or screening household or professional workers. See the prohibited uses listed in our Disclaimer.
5. Acceptable use
You agree to use the Site lawfully and respectfully. You will not:
- Harass, threaten, stalk, or harm any person, or use information to discriminate unlawfully;
- Scrape, crawl, or automate access in a way that burdens our systems or violates robots rules;
- Attempt to bypass security, access another user's account, or interfere with Site operation;
- Misrepresent your identity or affiliation;
- Use the Site for any unlawful purpose or in violation of applicable state or federal law;
- Promote TruthFinder or Site search results for FCRA-prohibited purposes.
6. Third-party services and terms
Many services are provided by independent third parties — licensed bail agents, mail and fulfillment vendors, phone providers, payment processors, OAuth identity providers, and TruthFinder. When you use a third-party service, you enter a direct relationship with that provider under their terms and privacy policies. We are not responsible for third-party acts, omissions, pricing, billing, subscription renewals, or data practices. Your use of TruthFinder is subject to their terms.
7. Payments and subscriptions
Orders for our family services are processed through our checkout flow and third-party payment processors. You authorize charges for the amounts shown at purchase. Paid TruthFinder memberships are billed by TruthFinder on a recurring basis until cancelled per their billing policy — review their pricing and cancellation terms before subscribing. Refunds are governed by our Refund Policy and, for TruthFinder, their billing policy.
8. Intellectual property
The Site's design, original text, logos, and compiled presentation are owned by PrisonAssist.com or its licensors and may not be copied or reused without permission. Public records displayed on the Site remain public records; our selection, arrangement, and added editorial content are protected.

10. Disclaimers
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DIRECTORY DATA OR THIRD-PARTY REPORTS ARE ACCURATE, COMPLETE, OR CURRENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRISONASSIST.COM AND ITS OWNERS, OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE STATES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Indemnification
You agree to defend, indemnify, and hold harmless PrisonAssist.com and its operators from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, violation of law (including misuse of records in violation of the FCRA), or infringement of third-party rights.
13. Disputes and governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except that mandatory consumer protection laws of your state of residence may apply to the extent they cannot be waived. Before filing a formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there, except where applicable law requires disputes to be heard in your home state.
14. Changes
We may update these Terms from time to time. Material changes will be reflected in the "last updated" date. Continued use after changes take effect constitutes acceptance. If you do not agree to revised Terms, stop using the Site and close your account.
